PRINCE EDWARD ISLAND INFORMATION AND PRIVACY COMMISSIONER
The Information and Privacy Commissioner of Prince Edward Island is an independent officer of the Legislative Assembly, appointed by the Legislature for a term of five years. The Commissioner is responsible for the overall administration of the office and reports annually to the Speaker of the Legislative Assembly on matters relating to freedom of information and protection of personal privacy.
Prince Edward Island enacted the Freedom of Information and Protection of Privacy Act (“FOIPP Act”) on November 1, 2002. Pursuant to the FOIPP Act, all public bodies are obliged to adopt a policy of accountability, openness and transparency and to provide a right of access to information, with limited exceptions. They are also obliged to ensure the protection of an individual’s personal privacy. The Commissioner conducts independent reviews of decisions of provincial public bodies under the FOIPP Act, including provincial government departments, boards, commissions, agencies and crown corporations. The Commissioner accepts appeals, known as Applications for Review. Applicants or third parties who are not satisfied with the response they receive from a public body as a result of an application pursuant to the Freedom of Information and Protection of Privacy Act, may apply to the Commissioner to review the matter.
